Oakland Raiders And UNLV Still At Impasse In Las Vegas NFL Stadium Negotiations The Oakland Raiders are still having problems in their stadium negotiations with the University of Nevada Las Vegas (UNLV). That much was clear in an obvious puff-piece that appeared Tuesday in the Sheldon Adeson-owned Las Vegas Review-Journal. While the intent was to send a message that all was well with the talks, the work actually had the opposite effect. Consider that the author cherry picked a quote from UNLV President Len Jessup, where the Prez said about the recent news of UNLV playing Cal “They literally want to be the first game in the stadium. We didn’t get those kinds of offers from Pac-12 schools for Sam Boyd Stadium. That’s a function of the new stadium.” Uh, let's not forget the UNLV vs Cal series will go on, new stadium or not. The rest of the article was a real nothing-burger. Here's why, and it can be summed up in this statement from Jessup: “Everybody’s busy. They’ve got so many other things they need to get done. And they’re in the middle of a season and they’re managing a team and renegotiating contracts. … I think it’s just that there’s a lot of work to be done here in a short amount of time. I really don’t want to say what specifically are the remaining items because I don’t think that would be fair to anybody involved in the negotiating on this thing at this point. I also have to say that once we’re done with this part of the process, we’re not done, because ultimately, it would then go to our regents. Thom (Reilly) has committed to the regents that that would be in a two-step fashion, one meeting where we would report out on everything and they would get to digest it and react to it, and then they’d get a little bit of time and then we’d come back in a second meeting with any revisions that are necessary to be able to vote on it.” Look, here's the fact: UNLV and the Oakland Raiders have been working on this Las Vegas Stadium Project since Mark Badain visited Jessup in late January of 2016, and behind the collective back of the City of Oakland and the County of Alameda – that's 670 days elapsed time, and counting! Come January 28th 2017, that will be two full years of talks. The problem is not hard to see for anyone who has experience in this area: UNLV is asking the thorny question of can the university afford a $1 million or more annual payment to the Oakland Raiders to use the stadium, considering the athletic department is running a deficit as this is written? Look at what Temple University is paying The Philadelphia Eagles to use Lincoln Financial at $1 million – which is the Raiders reported finanicial model for UNLV. Now, there's word the Eagles want to push that payment to $2 million – something UNLV is not equipped to afford. And UNLV has to be weighing that situation with the option of doing nothing with the Raiders, visting Nevada Governor Sandoval and asking to take over the stadium project (which UNLV can do according to the Southern Nevada Tourism and Investment Act), and needing to come up with only $200 million. (Something that any one of a number of UNLV backers, including Sheldon Adelson, would do.) It's a fair bet the Regents of UNLV know this. Stay tuned. Moreover, the act was done in a sneaky way: the Oakland City Council item that was the Tenant Relocation Ordinance had originally come from Councilmember Campbell Washington's own committee: the Life Enrichment Committee of which she is chairperson. Annie had time to make changes to it there, and before her own collegues. What she did, instead, was waited until the last minute and then pulled it without telling authors of the ordinance that she asked for changes to it. Well, author: Councilmember At-Large Rebecca Kaplan. The reason for the action was the Oakland Board of Realtors wrote a letter saying that the way the proposed law was written, it lacked a tenancy time period – they suggested three years in the letter to the City Council. Reached a moment ago, Councilmember Kaplan had this to say: “I continue to believe we must act to protect tenants in Oakland from displacement and I will keep working on these issues.” As a note, Annie Campbell Washington is running for reelection in 2018.

Oakland Raiders Las Vegas NFL Stadium Hotel Tax Rate Is Too Small For Bond Debt Service On $750 Mil

Last year, during the meetings of the Southern Nevada Tourism and Infrastructure Committee, I asserted that the proposed Clark County Las Vegas Raiders - UNLV Hotel Stadium Tax Rate of first 7-tenths of one percent, and then the approved 88-100ths of one percent were too small to service the proposed $750 million stadium subsidy bond. Now, this year, the actual stadium hotel tax revenue started to be collected in March, and shortly after that, I repeated my argument – the Stadium Authority reps said I was wrong. Now, we have eight months of stadium hotel tax revenue in, and what we see is this: the stadium hotel tax revenue should be 1.5 times the proposed monthly bond debt service – that is the debt coverage ratio. So, if the bond is only $700 million, as Stadium Authority President Steven Hill said it would be because they expected $50 million in stadium hotel tax revenue to be collected by the time the bond was actually floated by Clark County, then assuming 4.14 percent interest rate and 30 years, the debt service per month would be $3,398,651.34 – and the revenue from the tax rate per month should be $5,097,977. If we take the actual monthly stadium hotel tax revenue, and compare it to the monthly revenue needed to cover the debt service with a coverage ratio of 1.5, which is $5,097,977 – we get deficits for each month to date. So what if we extend the bond period to 40 years at the same interest rate? That would bring the debt service per month down to $3,190,000. Or let's just take it down to $3 million per month, which would call for $4.5 million in revenue needed per month. Guess what? Looking at our monthly revenue collected from March 2017 to now, we see a surplus only in the month of March – all other months show shortfalls. And show that the debt coverage ratio of 1.5 to 1 was maintained only for March and for no other month this year to date. In other words, under these circumstances, the hotel stadium tax monthly revenue stream is not enough to even think about floating a stadium bond of even $700 million, let alone $750 million – the revenue gap means Raiders stadium bond underwriters would ask to dip into Clark County's General Fund to make up the difference each month. In other words, the Clark County taxpayers would help pay for the stadium, not just the hotel tax. Early on in the 2016 SNTIC meetings, a smaller subsidy of $550 million was proposed, but the Oakland Raiders and Las Vegas Sands and Majestic insisted on the $750 million subsidy or they would walk away. Oakland Raiders Firing Of Ken Norton, Jr. Was Racist: Blacks Still Last Hired, First Fired On Tuesday, the Oakland Raiders reported that Head Coach Jack Del Rio fired his Defensive Coordinaotor (and friend of 25 years) Ken Norton, Jr. I don't believe Coach Del Rio made that move on his own, because of the logical inconsistencies that are attached to it – as well as the “last hired, first fired” pattern. It's a truism in American society that African Americans have historically been the last to be hired for a position, and then first to be released from it. In Coach Norton's case, after Del Rio was brought in as head coach, the Raiders took some time to hire a defensive coordinator, and talked to a number of candidates, all white, before settling on Norton (defensive expert Todd Bowles was interviewed to be Head Coachm not defensive coordinator). At that point, the Raiders were talking to black coaching candidates, but not hiring them - except former Raider Rod Woodson. The vast majority of hires were white; then the Raiders brought in Norton. Last hired. It's documented that Coach Del Rio was “grooming” Coach Norton for the defensive coordinator role, even as he held the job (http://ift.tt/2iIPduj). It's also widely known that Del Rio wanted to bring the Seattle / USC 4-3 style of defense to the Raiders, and Norton was the best person available, other than himself, to do so. Thus, Norton was an extension of Del Rio. There are two kinds of defensive coordinators in the NFL: the ones who are there to reflect the head coach's way of playing defense, and the ones who are there to install their own brand of defense. The later kind of defensive coordinators have become starts: Marvin Lewis, Rex Ryan, Rob Ryan, and their father, the late Buddy Ryan, to offer some examples. Then, there are those like Norton was, but admitantly not so tied to the hip of their head coaches as Norton, Jr. was – and therein lay the logical inconsistency. Or the first one. Since Coach Norton was brought in to install Del Rio's defense, and was being groomed by him, and since Del Rio, Norton, and now newly elevated coach John Pagano, were said to have equal roles in developing the defensive game plan, Del Rio should have fired himself as well as letting Norton go. As for Pagano, he's not a Seattle / USC 4-3 Defense specialist – he's a 3-4 defense guy. The most, again, logical, move would have been to keep Norton, but switch roles between he and Pagano – if a 'change' was really needed of that type. Frankly, it wasn't. The main Oakland Raiders Defense problem that plagues it has been one that I've pointed to since preseason: the defensive lineman come off the ball at a high stance, and thus lose the leverage advantage gained by being in a three-point stance. So, they're more easily blocked; the opposing quarterback has more time to throw. That puts more pressure on the defensive backfield, which gives up passing yards, at times in big chunks. On top of that, the Oakland Raiders Defense lacks the more exotic bliztes that are the norm today: attacks where specific gaps are 'overloaded' with two defenders on a blitz, like the “Double A Gap” approach, for example. The defense is predictable in alignment; no effort is made to use formations to emphasize strengths and cover-up weaknesses. All of these problems were there from 2015 to today, and Del Rio did nothing about them. The Head Coach just let Ken Norton, Jr. take all the heat, and then hired John Pagano, who was fired by the San Diego Chargers, and help with the defensive backfield. That was the story. He was really there to look over Coach Norton's shoulder – and give a reason for the Raiders to fire Norton at some point. An excuse. Yet another African American who didn't work out in the coordinator role: same thing happened to Pep Hamilton. He was the Indianapolis Colts Offensive Coordinator, and in 2013 and 2014 built one of the NFL's top attacks. But one bad year, 2015, and next thing you know, he's fired. Stay tuned. Berkeley Still Has Racism Problem Says FBI Data, After W. Kamau Bell At Elmwood Cafe On January 29th 2015, local Oakland and Berkeley comedian W. Kamau Bell went to the Elmwood Cafe at 2900 College Avenue to meet his wife and friends. But all the Cafe worker saw was a black man talking to a white woman. The worker came out and told him to “shu” and go away. Mr. Bell reported what was an obvious act of racism. Now, in 2017, Berkeley is not better. According to FBI hate crime statistics, there were 13 race based hate crimes in Berkeley alone: over one per month. And the same FBI statistics also report that the hate crime is more often to be a white person against a black person. Why? It may be a function of the affordable housing problem as well as the lack of well paying low skilled jobs. These problems disproportionately hit blacks, especially in The SF Bay Area - and leads to such racism - classism problems. But even with that, we have to work to make racism unfashionable. GOP Tax Plan, Potential Oakland Raiders Las Vegas NFL Stadium Killer, Up For Vote Thursday

GOP Tax Plan, Potential Oakland Raiders Las Vegas NFL Stadium Killer, Up For Vote Thursday The Oakland Raiders held a party for the groundbreaking of the planned Las Vegas NFL Stadium, (supposedly) in partnership with the University of Nevada – Las Vegas, last night. While many were reportedly congradulating Raiders Owner Mark Davis, he was heard to have said “we haven't done anything, yet.” Not only is Davis correct, but the United States House of Representatives is officially set to vote on what's referred to on the street as The GOP Tax Bill or GOP Tax Plan. That piece of legislation contains a section that could kill the Raiders Las Vegas deal. The part of the GOP Tax Plan, which is called the “Tax Cuts and Jobs Act”, that is of concern to the Oakland Raiders (as well as all of sport) is Sextion 3604. As I wrote in my post on this from last week “Section 3604 mention and take direct aim at what are called “professional stadium bonds” and reads “any bond issued as part of an issue any proceeds of which are used to finance or refinance capital expenditures allocable to a facility (or appurtenant real property) which, during at least 5 days during any calendar year, is used as a stadium or arena for professional sports exhibitions, games, or training.” That effectively kills the very bond issue planned for the Oakland Raiders Las Vegas Stadium. Period. There’s no guessing about the intent of that Section 3604 provision: it’s about as subtle, as Miami Dolphins Head Coach Don Shula might say, “as a punch in the face.” A tax exempt bond is commonly issued by a municipal government.” A number of reports have said the GOP Tax Plan is coming for a vote before the U.S. House Of Representatives, but I can report that, according to the House Majority Leader, it's coming up for vote this Thursday, November 16th. What I wrote on November 8th still applies: In the case of Las Vegas and the Oakland Raiders, and the law that spawned the NFL Stadium Plan, that public body is Clark County, Nevada. Under the “Tax Cuts and Jobs Act”, Clark County would be acting against the law in even meeting to consider doing the Raiders Bonds as the law, the Southern Nevada Tourism and Investment Act (SNTIA), instructs. Indeed, the entire part of the SNTIA would be rendered not legal if the GOP Tax Plan passes with Section 3604 intact. And a restructured Raiders Bond would have to be what is called a “revenue bond” and issued by an entity other than Clark County. The Raiders Bonds could not be issued by Clark County, as that would be illegal, and would have to rely on revenue streams generated from the stadium itself. A new, private firm would have to be formed and that would have power to issue the Raiders Bonds. The Stadium Hotel Tax could still be used, but given it’s paltry 88-100ths of 1 Percent Rate, the revenue throw-off, already small, would be almost miniscule compared to the additional debt. Trying to draw from the stadium revenue flows would quickly reveal that the Raiders already have a $27 million annual deficit in revenue from the stadium, and that’s because of the Bank of America Commercial Loan of $850 million for the stadium, and its debt burden on the stadium. Indeed, the SNTIA numbers from the meetings of the Southern Nevada Tourism and Infrastructure Committee show that such monies as event revenue were already estimated, so when you ‘park’ the Bank of America Commercial Loan into the spreadsheet, you come out $27 million in the hole – annually. And that’s before GOP Tax Reform. With GOP Tax Reform, you have bond underwriters trying to dip into a stadium money source that was never really there. The $27 million stadium operating cost deficit would just grow to massive proportions in a correctly done spreadsheet. And then there’s the construction subsidy bond for the $750 million. According to conversations I’ve had with friends who are in the sports team financing business, the new interest rate for the private version of the Raiders Bonds would be around 9 percent, or greater. When I parked that higher rate into my Raiders Bonds Calculator, that added $2.393 million in monthly debt service costs, or $28.719 million in total annual debt service costs to the bond, coming to $861,572,693.20 over the 30-year bond debt service period. Given that the current average monthly Stadium Hotel Tax Revenue that would go to the Raiders Bonds is $4.190 million, and the required Stadium Hotel Tax Revenue per month after passage of the GOP Tax Plan would be $9.052 million, it’s not hard to see that the stadium plan can’t be financed either by tax exempt bonds (because they’re not legal under the plan) or by Private Bonds given the giant debt service costs, far in excess of the current revenue stream and the small Stadium Tax Rate that caused it. Anne Kirkpatrick Oakland Police Chief Promised Reform , Keeps Status Quo On January 5th, 2017, Oakland Mayor Libby Schaaf announced she was hiring Anne Kirkpatrick to be the new Oakland Police Chief. This was done after months of community meetings and interviews with many candidates. And rather than elevate the popular Danielle Outlaw from the rank of “deputy” to become Oakland's first female (and black female) chief of police, Schaaf brought in an outsider: Anne Kirkpatrick. At first, Anne Kirkpatrick sounded all of the right bells, saying she was “interested in reform.” But perhaps Police Chief Kirkpatrick gave us a preview of her real intensions when she said she was “interested in reform”, rather than 'will implement reforms' – because to be interested means one thinks reform's something to consider, but 'will implement reforms' means change is coming, period. Not only has Police Chief not made change, she's kept on many of the same bad egg police officers who were behind the Oakland Police Officer Sex Scandal. The same one where the City of Oakland wound up coughing up $1 million to Jasmine Abuslin, the victim at the focus of the scandal. And not only did she keep them on, she gave some of them promotions. In other words, they got thanks for screwing with an under-age girl on company time and with Oakland taxpayer money. And in the latest controversy in the young tenure of Oakland Police Chief Anne Kirkpatrick, she is accused of making false statements, of working with Mayor Schaaf to spearheaded the removal of the OPD report from the Oakland City Council Agenda this week – the one on the events behind an Immigrations and Customs Enforcement (ICE) raid that took place in West Oakland on August 16th 2017. The ICE raid set forth a series of actions to dissolve the contractual relationship between ICE and OPD – one that existed in contradiction to Oakland City Council desires. Thanks to Oakland City Councilmembers Rebecca Kaplan and Desley Brooks, I have the report that was taken off the public record, and have placed it for public view here: http://ift.tt/2ADeI7s Kaplan said “I think it's inappropriate to try to hide this report and vital that we clearly protect our community from “ICE”. She's right. And not alone. A group of Oakland Residents – Bryan Hofer, Tracy Rosenberg, Rev. J. Alfred Smith, Margaret Cunningham, Pamela Drake, Sharon Rose, Judith Stacey, and Linda Olvero – filed a complaint against Chief Kirkpatrick, claiming that she made a series of false and misleading statements covering up the Oakland Police involvement in the ICE Raid in West Oakland. Read: http://ift.tt/2yv73Hb The cover story the complaint points to is in the report that was pulled from the City Council agenda, and claims that OPD's only role was in traffic control to protect residents while ICE conducted a service of a search warrant. That was not true, because the complaint filed contains a copy of an August 16th 2017 record of deportation of a man named Santos Alberto who lived in West Oakland. In other words, ICE was going to get and deport Mr. Alberto, and got the Oakland Police Department to help. This, in full violation of the Oakland City Council's stated policy of refusing to assist such immigration enforcement actions. This seems to paint a picture of an Oakland Police Chief who says one thing and does another. For example, Police Chief Kirkpatrick promised police reform, but according to the Chicagoist, Kirkpatrick, up for consideration as Superintendent, and retired Spokane Police Chief, wrote a job response that basically said she was a believer in Stop and Frisk and the methods advocated by New York Police Commissioner William Bratton, and wrote that police could police themselves. Considering that Chief Kirkpatrick gave OPD Sex Scandal-involved officers promotions, it's clear she has no intent on reforming the troubled department, and believe Oakland police officers can and will police themselves. Oakland Raiders | Las Vegas Raiders NFL Stadium Groundbreaking Can’t Mask Problems There's a lot of buzz generated in anticipation of the planned groundbreaking for the Oakland Raiders Las Vegas NFL UNLV Stadium. The event's supposed to be held this Monday, November 13th, and as these things will do, is already causing some people to think that the stadium's going to pop-up overnight. Also, the Raiders sudden change in messaging has contributed to this. About a month ago, the general word was the Raiders were seeking to stay in Oakland through 2022, and maybe not even move to Las Vegas. There were and still are good reasons for that. But after One October, something not talked about publicly happened such that the Raiders are now talking about a 2020 Stadium opening, and even having the NFL Draft in Las Vegas in 2019, which is a complete joke because the Stadium's not going to be ready. Still, Oakland Raiders President Marc Badain put on his snake oil salesman suit, and trotted out that pablum to an audience that could eat it and think it was steak. And so it goes with this groundbreaking event. But the reality is there are a number of reasons why the Raiders groundbreaking is meaningless at this point, and the Silver and Black could still wind up without a stadium. Let's see what remains to be done: 1) 13 of All 14 documents, including the UNLV Joint-Use Agreement and the Community Benefits Agreement, must be made and signed by all parties. 2) UNLV has no incentive to sign the Joint-Use Agreement with the Raiders, as by dragging its feet to May 16th 2018, the University can then take over the project from the NFL team by law – The Southern Nevada Tourism and Investment Act (SNTIA). 3) The matter of why it's taken seven months (and counting) to do soil and land analysis has never been answered – don't expect the reason to be revealed at the groundbreaking, let alone how much it's really going to cost to prep the land. 4) The gap in financing between what the cost is to provide parking for 14,000 cars and also to improve the highway and streets and roadways for the stadium has never been filled. Moreover the SNTIA says the Raiders as developer have to pay for some of that cost. 5) The Stadium Hotel Tax Revenue, already not producing the money that was projected per month. The Las Vegas Stadium Authority is trying to put its best face on a bad problem, but it's a real issue. And that leads to... 6) The impact of One October is on such a terrible scale that it's reasonable to believe the casual traveler is less likely to come to Las Vegas. That hurts hotel occupancy, which depresses the Stadium Hotel Tax Revenue, which makes it more a chance that Clark County's General Fund is tapped into. The problem is the 1.5 to 1 debt coverage ratio – it should have been 2 and the tax should have been 1.4 percent and the not less than 1 percent it is now. 7) The loan debt from the Bank of America Stadium produces a 27 million additional annual operating cost. The Raiders have not identified a revenue stream to pay for the loan. Where's the additional sponsorship revenue needed beyond what was projected in the SNTIC reports? Those are the major issues standing in the way; if I added the minor ones the total list wouild be twice as long. There are other issues like drainage and the channel at the north end of the property. I could go on and on. And then there's the GOP Tax Plan. There's no stomach to take out the anti-pro-sports-stadium tax exemption provision. And if that happens, I don't care what Steve Hill says, the deal's dead. Stay tuned. Blacks Blast Oakland Raiders Hiring Plan For Las Vegas NFL Stadium The Oakland Raiders have to complete 14 primary agreement documents before financing for and construction of the Las Vegas Stadium can start. One of the docs is called the "Community Benefits Agreement" or a kind of hiring plan and guidelines for helping the minority underserved people of Southern Nevada. Basically, it's supposed to make sure blacks get jobs. A draft of it was presented at yesterday's Las Vegas Stadium Authority Meeting, but before the matter was brought up, a number of African American laborers came forward to express their displeasure with the draft, saying that blacks are left out of it and will not get jobs. The most horrible portion of this video was when Tommy White, the executive over the 872 Local Union, tried to use Roberts Rules of Order to silence a black woman who came forward to speak on how (she claims) his organization has worked against minority involvement in the Raiders Stadium. The fact is the woman was speaking on matters related to the Community Benefits Plan that was on the agenda, but both White and Authority President Steven Hill tried to say she was not doing that - she was. Las Vegas Woman Asks Why Have Contract To Hire Minorities For Oakland Raiders NFL Stadium

The Las Vegas Stadium Authority Board November 9th 2017 meeting featured a contentious round of conversations between the Oakland Raiders, who have worked to lay the groundwork for the construction of their controversial new stadium in Las Vegas, and the LVSA over minority hiring goals and timetables. The proceedings were punctuated by this Las Vegas woman, a contractor herself, who openly asked a question "Why do we have this crap about what you have do for blacks, Hispanics, Asians...?" Yes. She said that. But what she reveals is a kind of culture clash between the old ways of doing business in Las Vegas and a new way imposed by this large, politically sensitive project. Perhaps she mispoke, but she certainly revealed how frustrated some of the old guard are with a more bureaucratically managed system of making sure blacks get work in large development projects in Las Vegas. Las Vegas Stadium Authority Meeting Shows Oakland Raiders Problem With Minority Hiring For NFL Stadi

The Oakland Raiders have worked to lay the groundwork for the construction of their controversial new stadium in Las Vegas. All of this started with the passage of a Nevada Bill called The Southern Nevada Tourism and Investment Act, and approving a $750 million public subsidy to help pay for the sports event center. The law also calls for minority hiring.
