Is Elizabeth Betsy Lake Oakland's New Deputy City Administrator To Be Mayor's Lawyer vs Oakland Global? Past Docs Say Yes. Elizabeth “Betsy” Lake is the new City of Oakland Deputy City Administrator. In the press release announcing her hire, one of the reasons given was that she “has worked with the City of Oakland and the City of Richmond on various redevelopment efforts, including the Amy Base Project in Oakland”. But what the press release did not report was what an October 21st 2014 Oakland City Council closed session agenda still available for view online did: that Lake was listed as one of the “chief negotiators”: the agenda reported that the Oakland City Negotiators were: Henry Gardner, Arturo Sanchez, Doug Cole, Pat Cashman,. John Monetta, Dianne Millner, and Elizabeth Lake. With the negotiating parties being the developer, Prologis/CCIG: Phil Tagami, Mark Hansen, Daniel S. Letter, and Marc Stice. Prologis/CCIG is the developer of Oakland Global, the under construction Oakland Bulk & Oversized Terminal – the project at the center of the coal controversy. And the online-posted record of involvement of Elizabeth “Betsy” Lake in the Oakland Army Base Project, as it's called, doesn't stop there. On October 13th 2013, the firm Ms. Lake was a partner in, Holland & Knight, issued a press release telling the World that the law organization “worked closely with Barbara Parker, the Oakland City Attorney, and Dianne Millner, the City's legal team leader on the project, to complete necessary negotiations and agreements.” Then Ms. Lake is quoted as saying “We are very pleased that the city of Oakland, our client, and the private developer, Prologis CCIG Oakland Global have come together to make this development go forward. This work secured a $176 million state grant to assist in the build out. The project is expected to take five years to complete." Then the press release continues “The Oakland Army Base is a 360-acre former base adjacent to the Port of Oakland. The project to be built there is intended to make the site a world-class intermodal trade and logistics center. Prologis is one of the world's largest developers of port-oriented logistics facilities and is partnering in this project with Oakland-based California Capital Investment Group (CCIG).” That allows me to conjecture that Elizabeth “Betsy” Lake has a lot of documents the public may not have seen, and perhaps were not brought up in the recently concluded court battle between Oakland Global and the City of Oakland over the issue of the Oakland Bulk & Oversized Terminal and whether it should be allowed to continue to be able to handle the transfer of coal, among the various types of minerals it was expected to see during its operation, and (as the developer contends) was established in the 2013 development agreement between the City and Oakland Global, LLC. Betsy Lake ads an institutional memory that, if Ms. Lake had some hand in creating letters leading up to and that include the development agreement, could cause us to answer the question “Did the City of Oakland really know that it was approving a faciltiy that was planned to handle different minerals, including coal in 2013?” Considering that I just found one document online that is a legal description of the land to be transferred to Oakland Global, LLC / Oakland Bulk & Oversized Terminal LLC, the answers to that question seems to be 'it would seem so'. But what this proves is that in Elizabeth “Betsy” Lake, Oakland Mayor Libby Schaaf has the lawyer and land use expert who worked on that project as her new employee. Schaaf now has the luxury of having her own in-house lawyer and not having to turn to the staff of Oakland City Attorney Barbara Parker. Is Clark County Playing Bait & Switch With Oakland Raiders And Las Vegas Stadium Bonds?
Will the Oakland Raiders have to pay $100 million of what was to be a Clark County-provided $750 million subsidy, thus making it really a $650 million subsidy? Or will the Silver and Black have to pay any level of money toward the bond issue that wasn't clearly explained while the deal was being formed in 2016? Did Clark County play “bait and switch” with the Raiders, promissing a $750 million subsidy, but really giving less because the Raiders had to pay the County part of that money? According to the 2017 “Clark County Debt Management Policy”, (page 69) which says that the County will only 'backstop' $650 million in bonds, as the policy reads “The bonds will be additionally secured by other dedicated incremental increases to the region's hotel room tax rate, the intended repayment source, that are 0.88% for the Las Vegas Strip area and 0.5% for surrounding areas. The public subsidy is limited under Nevada's Senate Bill 1 to $750 million from a combination of tax collections and bond proceeds. These dedicated room taxes are already being collected and deposited to a special account for the project.” “The Clark County Debt Management Policy”, available on the County's website as of this writing, essentially left a $100 million gap between what the County would ask the taxpayers to protect if the stadium hotel tax revenue for the bonds fell short of required debt service and coverage ratio levels. In other words, that $100 million gap would have to be filled in, in part, by the waterfall, or the “dedicated room taxes are already being collected and deposited to a special account for the project” - but who pays the difference between that and the total of $100 million needed to reach $750 million? Given that the Raiders are the stadium developer, it would have to be Oakland. Right now, that “dedicated room taxes are already being collected and deposited to a special account for the project” totals $44,499,967. Thus, the gap the Raiders have to fill is $55,500,033 if all of the $750 million is to be accounted for with respect to the bond issue. The trouble is, according to the Clark County debt policy document, the Raiders aren't really getting the kind of public subsidy they would not have to pay in – instead, they don't have a true “public subsidy”. And the Raiders are being asked to pay the first $100 million of stadium construction – something the organization's doing right now. But that's $100 million in addition to the $55,500,033 – so the Raiders real up front cost before bonds can be floated is $155,500,033. If the Raiders refused to pay the $55,500,033, the team would have to wait for the “dedicated room taxes are already being collected and deposited to a special account for the project” to reach $55,500,033. And according to my projections based on the rate of collection to date (which, itself, has been less than expected), that could take another 13.7 months, pushing back the stadium financing time, and delaying the construction of the facility by a year in the process, since there would be no money to pay for building activity, as the bonds would not be floated by Clark County until that $55,500,033 mark was reached. How we got here. When the Oakland Raiders Mark Davis and Team President Marc Badain visited the Southern Nevada Tourism and Infrastructure Committee in 2016, one of the first stipulations of any continuation of talks toward building a new NFL-ready stadium in Las Vegas was that the State of Nevada and Clark County provide a subsidy of $750 million. When it looked like the Southern Nevada Tourism and Infrastructure Committee (SNTIC) Consultants were going to give less in a public subsidy than the $750 million the Oakland Raiders and Las Vegas Sands and Majestic Realty (who were partnered) wanted, Mr. Badain said he was “disapponted” with the alternative proposal of a $550 million subsidy, and threatened to walk away from the SNTIC. So the SNTIC Consultants went back to work and fashioned a way that, on paper, it looked like a $750 million subsidy was affordable to Clark County without raising the hotel tax rate to one percent or greater – the rate is 88 100ths of 1 percent. The final version of the subsidy called for collection of the staidum hotel tax until a “waterfall mark” of $50 million was reached – this would allow Clark County to float a bond of only $700 milion, but contribute a total subsidy of $750 million. That was the idea presented – or so it seemed. Trouble is, it seems the Raiders were not made aware of the $650 million backstop issue. As of now, the Las Vegas Stadium Authority has not determined how large the bond issue will be, and that's due in large part to the less-than-expected performance of the stadium tax revenue What will the Raiders do? http://ift.tt/2GGbsKY

Star Control Game Creators Sue Stardock Systems, CEO Brad Wardell For Copyright Theft SAN FRANCISCO—Computer game developers Paul Reiche and Fred Ford are defending their ownership and rights over two iconic games they designed and developed in the late 1980s and early 1990s, Star Control and Star Control II, after game publisher Stardock Systems, Inc. sued Mr. Reiche and Mr. Ford in an apparent attempt to take control of the games and profit from their popularity. Stardock and its chief executive, Brad Wardell, initiated the lawsuit against Mr. Reiche and Mr. Ford on Dec. 8, 2017. Today Mr. Reiche and Mr. Ford filed a counterclaim against Stardock in U.S. District Court in Oakland to take back control of their rights to the Star Control I and Star Control II computer games. “Star Control is a pair of games we created at the start of the computer gaming revolution,” said Mr. Reiche. “Now, largely as a labor of love, we are returning to the universe we created to update it with new adventures, characters, and worlds. Stardock seems to think not only are we not the creators of Star Control, but they claim to have the exclusive rights to sell our games and otherwise use our alien races, ships, narrative, and other creative materials without our permission. This is why we felt compelled to file our counterclaim today to stop Stardock’s theft of our games, copyrights, and the universe we created for ourselves and our fans.” The game creators are asking the court for an injunction to stop Stardock from illegally selling their games and otherwise using their creative materials, which is infringing on their copyrights, to stop Stardock from engaging in other forms of unfair competition, and to order Stardock to pay the developers all revenues and profits the company has gained from selling the games, as well as to force Stardock and Wardell to stop using their “The Ur-Quan Masters” trademark. Mr. Reiche and Mr. Ford created and developed the Star Control I and II games between 1988 and 1992, and they were published and sold by Accolade. The space adventure games and their unusual characters and storytelling quickly gained popularity at the time of their release. Over the years, the games have developed a cult-like status as classics and are widely considered to be among the best computer games ever made. Carson Abt: I know that there are a little different solutions but one was about all the drills and protocols - through research I found only 32 states require drills.... I think a change that will increase all the training and protocol so if a shooting does happen, at least all the teachers will be prepared and keep students safe. Justin Gruber - I'm only 15 yrs old... I was born into a world where I never got to experience safety and peace. This has to never happen again. People need to feel like when they go to school they can be safe. Parents shouldn't have to go through the idea of losing their child. Cary Gruber: [My son was] texting me hiding in a closet, if something happens I love you. You can't imagine what's that like as a parent. 17 lives are gone. I was lucky enough to get my son home. It's not political. It's a human issue. People are dying and we have to do this. If he's not old enough to go buy a beer. He should not be able to buy a gun. It's just common sense. Andrew Pollack: She was murdered last week and she was taken from us. Shot 9 times on the 3rd floor. We as a country failed our children. I can't get on a plane with a bottle of water. We protect airports, concerts, stadiums, embassies, the Department of Education that I walked in today that had a security guard in the elevator. I'm very angry because it happened. Oakland Raiders Mark Davis Tee Martin Comment Sounds Racist After NFL Rooney Rule Issue Mark Davis needs to issue an appology to USC Offensive Coordinator Tee Martin if the Sports Illustrated report of what he said about the coach of the man who could be the first player picked in the 2018 NFL Draft are true. In an interview with Sports Illustrated's MMQB's S.L. Price, Davis is quoted as saying “To spend $20 million, and on top of that hire Tee Martin? No. What I would’ve done is probably brought in a president - somebody with X’s and O’s ability - to work with Jack, and I would’ve gotten some more competent coordinators,” is reponse to the question if he would have retained Jack Del Rio as Raiders Head Coach if Gruden wasn't available. Think about that. USC Quarterback Sam Darnold is that player said by some to be the best signal caller coming into the 2018 NFL Draft - Tee Marin coached him. Tee Martin was also the designated Rooney Rule interview selected by the Raiders during their search for a head coach. Even though Martin certainly knew that the Raiders Davis wanted Jon Gruden, he flew up to Oakland for the meeting anyway. For anyone who knows offensive football, what Tee Martin does in the use of line spacing in the running game is something to study. Maybe Mark Davis didn't get that memo? I have to say that what Davis said sounds racist. In other words, Davis might as well have blurted out “look, we just talked to Tee Martin because the NFL says we have to talk to a black guy before we get the white guy we want - Gruden. But hire Martin? Are you kidding me?” Wow. Davis' comment about Martin is sad because he's the same person who asked me to develop a new stadium plan for the Oakland Raiders. My long-time-friend Michael Silver, now of the NFL Network, was there to see it. To make a long story short, I developed a detailed financial plan for a combination stadium – hotel resort facility, then cold-called Piper Jaffrey Investment Banker's Managing Director Diane Paauwe, who in turn assembled a deal team to look at my spreadsheet and plan. They said it would work and wanted to move forward to talk with either the Raiders or the City of Oakland, or both. I called the Raiders and sent emails reporting the good news, and got no call back. And while there was an active Exclusive Negotiating Agreement at the time with another potential stadium developer, those talks were going nowhere. Moreover, the ENA did not expressly block the Raiders from listening to an idea as opposed to actually doing another deal with a new developer. The Raiders could have called Oakland Mayor Libby Schaaf and asked her to end the ENA so they could freely move freely in another direction. Then followed up with me and Piper Jaffrey – especially considering what Davis asked me to do that started all of this! Instead what I got was nothing except a constant impression that Davis is afraid to talk with me about anything, face to face. Fortunately that's not true for a number of other people on his staff, who shall remain nameless. But I could not help but wonder if Davis had some issue with me simply as a black man who is intelligent. I would constantly dismiss that idea, but after the Tee Martin comment, I am forced to think about that all over again. It reminds me of what Bell Hooks wrote in “We Real Cool: Black Men and Masculinity”: “Well-educated black men have learned to act as if they know nothing in a world where a smart black man risks punishment.” And that's because some consider us dangerous. Solving a stadum finacing problem, or coaching an NFL football team should not be considered undesirable for someone black to be able to do, male or female. I keep remembering that Davis asked me, to come up with a plan but maybe, in retrospect, he meant it as a joke, thinking I couldn't do anything. Surprise!

Oakland Raiders Coliseum Lease Talks Continue With 2020 As Target Before Las Vegas The Oakland Raiders talks with the Oakland Alameda County Coliseum Joint Powers Authority about a lease extention continue, and with the target end date being the 2020 NFL Season. According to a well-placed friend of mine, the details of the negotiations call for, as of this writing, a rent structure that essentially doubles each year to 2020. At that point the Raiders expressed concern that the proposed rent (said to be around six million at that point for 2020) was too expensive. It is. I'm told that the Coliseum JPA reportedly suggested the Raiders talk to Jed York about playing at Levi's Stadium for the 2020 Season. What this reflects is a clear belief amoung the Coliseum JPA minders that they have been both lied to and used as the Raiders continued to develop a process toward a new stadium. Many of the Coliseum JPA Board Members would love for the Oakland Raiders to reverse course and stay in Oakland. Many of the Coliseum JPA Board Members are also still very much (and the best way to characterize this is) pissed off that (in early 2016 and with evidence to prove it) the Raiders organization went behind the joint-powers authority's collective back and made a deal to build a new stadium in Las Vegas. By contrast, the Oakland Raiders never once made an earnest, focused, singular attempt to build a stadium in Oakland. Moreover, while holding talks on new stadium infrastructure costs that had already been determined years ago by the City of Oakland, the Raiders paid for the creation of a conceptual video of how the MANICA-designed Carson Stadium would look. And that design formed the basis for the Las Vegas Stadium that's in the predevelopment and land preparation stage right now. So it's under that clouded recent history that the Oakland Raiders negotiations for a lease extension have taken place. Is Lamar Jackson Downgraded In 2018 NFL Draft For Being Black QB Dissed By Bill Polian? Lamar Jackson is without a doubt the best player at the quarterback position in the 2018 NFL Draft. Consider that Jackson's a top 20 leader in the 2017 NCAA Passing rankings, and a 2017 top 10 leader in NCAA Rushing rankings, for a giant 5,261 yards of total offence for one year. Oh, and did I mentoon that the 2016 Heisman Trophy winner was the 2017 Heisman Trophy runner-up? For all of this, and a classy off-and-on the field character, Lamar Jackson is... considered by some to be a running back? Yeah, in the era of Deshon Watson, there's some who would really put that out there. Or is it just that? Where's Lamar Jackson's agent in all of this? Well, Lamar Jackson's agent isn't anyone you've ever known and especially not CAA Sports, which has an annoying habit of having its players wind up getting TV endorsements from ESPN and the NFL Network, even if they're not really the best players on the board. Let's take USC Quarterback Sam Darnold. In the game's I've personally attended, Mr. Darnold is fantastic at running the Tee Martin-designed USC Offense. But once you are able to use your 3-4 adjusted to stop the inside run by bringing the ends inside the offensive tackles, and mix in the occasional outside linebacker or safety blitz, Darnold can be rendered less than effective, and prone to throw interceptions. NFL Network's Mike Mayock thinks Darnold's the best quarterback. Ah, OK. By contrast, Lamar Jackson is a complete offensive weapon. His running ability has produced exciting results when a passing play broke down, or when he was called on to run by play design. And if you mention his 10 interceptions, my counter is Darnold threw 13 and that I can point to some interceptions that were the fault of a receiver tipping the ball, rather than Jackson making a bad throw – thus reducing the number to eight or nine interceptions. But given the choice between Darnold and Jackson, the Cleveland Browns would be completely stupid to pass on Lamar Jackson. So, why is he downgraded? Part of the problem is a set of negative comments made by ex-NFL General Manager Bill Polian. It was Polian who tesily said that Jackson should line up as a wide receiver, and then more recently stated it again from his ESPN platform. So, I wondered: what does Bill Polian really have against Jackson? And then I wondered if Bill Polian was ever high on any black NFL quarterback prospect? So, I checked: Jameis Winston? Nope. Cam Newton? Polian thought he was average. Both Winson a and Newton were taken number one in the 2015 and 2011 NFL Drafts respectively. Rusell Wilson? After Seattle drafted him, Polian said ““He’s not going to be a starting quarterback.” We all know the NFL histories of Winston, Newton, and Wilson. Who else? Is there one black QB Polian liked? Let's see, Polian was said to have been “not interested” in Michael Vick. He blasted the Buffalo Bills for picking E.J. Manuel in the NFL Draft. Polian did everything to suggest Tyrod Taylor should not be in the Buffalo Bills plans for the future, then said he was a “perfect fit” after it was obvious that Taylor was a perfect fit for the Bills. In other words, Polian did everything to discredit Taylor, until he was put in control of the Bills Offense and did well – then, he had to admit that Taylor was the answer. And that, as Mel Kiper, Jr said that Lamar Jackson's style was like, who else but Tyrod Taylor! So, it's starting to look like our legendary NFL Hall of Fame GM Bill Polian might have an un-intended racially based bias he has to work on. It's not personal to Mr. Polian, who's a nice man from my experience, but it's something that he might consider as being a block to his ability to fairly evaluate Lamar Jackson.

City Of Oakland Reaches Tentative Agreement On 2 Year Contract With Union SEIU Local 1021 Oakland, CA — The City of Oakland and Service Employees International Union (SEIU, Local 1021) have reached tentative agreement on a two-year contract, which the union will put to their members next week for a vote, and if approved, will be presented to the Oakland City Council for ratification. Local 1021 tentatively agreed to the same wage proposal ratified by the other three civilian employee labor groups—the International Federation of Professional and Technical Engineers (IFPTE), Local 21; the International Brotherhood of Electrical Workers (IBEW, Local 1245); and the Confidential Management Employees Association (CMEA). The tentative agreement provides a wage increase of up to 6% over the two-year contract, as follows: · 4% retroactive to July 1, 2017 · 1% effective January 2019 · Up to 1% more in the second year of the contract, depending on City revenues, effective January 2019 Once the tentative agreement is ratified, the City will have two-year contracts in place with all four civilian labor groups. Negotiations with International Association of Fire Fighters (IAFF, Local 55) are ongoing.

MSG Sphere Las Vegas Is Sands Plan To Derail Oakland Raiders NFL Stadium The Oakland Raiders Las Vegas NFL UNLV Stadium’s future fiscal fate was sealed in New York City, at Radio City Music Hall on February 8th 2018. That is the day James Dolan, NY Knicks Owner and head of Madison Square Garden, introduced an 18,000 seat, 600,000 square foot plan for a globe-shaped music and entertainment arena called MSG Sphere. The 300-foot-tall building will be the result of a partnership between Las Vegas Sands and MSG, be built on a lot next to the giant Ferris Wheel, and present what will be the most sought-after place to perform in, in the World. And take away many big events that The Oakland Raiders and Legends Entertainment believed could be landed for the 65,000 seat facility. Indeed, that, combined with the fiscal debt put on the Raiders Stadium by the Bank Of America loan, will combine to make Las Vegas Stadium Authority Board Member and MGM Exec Bill Hornbuckle’s concern that the Raiders could not draw more than 46 large events annually a reality. That was the number of big events the Raiders, Las Vegas Sands, and Majestic Reality said they could get and needed and needed if the stadium was expected to operate and generate a profit, paying off its expenses and debt in the process. 46 was a number met with disbelief by many. While the number included Raiders Games and UNLV games, that total, including preseason, ads up to 16 events, leaving a gap of 30 events. It was anticipated that stadium size concerts would make up the annual gap, as well as contests like mixed martial arts. But between the existing T-Mobile Arena, and the coming MSG Sphere, not to mention Jackie Robinson’s NBA Arena project, the once achievable mark of 46 events now has to be questioned - along with the fiscal viability of the Raiders Stadium in Las Vegas. In short, The Raiders Stadium Project is in trouble: the Stadium Tax Rate isn’t producing enough revenue for the bond issue to be paid for without dipping into the taxpayers pocket, the Infrastructure costs are adding a half-billion in additional costs, the Raiders pissed off once-partner Las Vegas Sands, the Raiders have upset the current fan base, there is no clear idea of who will offer sponsor money, the idea that people will come is questionable given the ticket, travel, and hotel price points, the workers are arguing over who gets the jobs, and Sands itself along with MGM seems determined to siphon off events and money from it. With all that, why do it? And why continue with the idea that it’s going to be open in 2020,when everyone knows that is not the case? Stay tuned.
